These Terms of Service ("Terms") govern your access and use of the digital products and services operated by S.R. Arguello Durán, trading as Sabinitty(formerly marketed as Pikkakola), a sole proprietorship (eenmanszaak) registered with the Dutch Chamber of Commerce (KvK) in Almere, the Netherlands (KvK 42008591, BTW-identificatienummer: NL584683741B01, KOR where applicable).

By using Sabinitty, our pregnancy and family wellness application, you agree to be bound by these Terms and our Privacy Policy.

1. Description of Services

Sabinitty is a digital pregnancy and family wellness application providing organizational and informational tools — including week-by-week tracking, appointments, milestones, journaling and family sharing. Sabinitty is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult your doctor or midwife.

2. Accounts and Eligibility

You must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. If you sign in with Google or another provider, you must still accept these Terms and our Privacy Policy before using the service.

3. Subscriptions and Payments

Sabinitty offers a free plan and optional paid plans (Premium Mamá and Premium Familia) billed via Stripe. All prices are listed in euros (€). VAT is applied as required; while the business is eligible under the Dutch Kleineondernemersregeling (KOR), prices may be VAT-exempt.

You may cancel at any time through the self-service billing portal and retain access until the end of your current billing period. For digital services, by starting your subscription immediately you acknowledge that the 14-day right of withdrawal (herroepingsrecht) ends once the service begins, in accordance with EU consumer protection law (Directive 2011/83/EU).

4. Your Content & AI Features

You retain full ownership of the content you create (journal entries, photos, logs). Optional AI-powered features (including the "Sabi" companion) are clearly disclosed as automated assistance, provided "as-is" for informational purposes only and never replace professional medical advice. Under the EU AI Act, you are informed that you interact with an AI system; you remain responsible for any decisions you make. Always consult your doctor or midwife.

5. Acceptable Use

You agree not to:

Use the service for any illegal or harmful purpose
Attempt to reverse-engineer, exploit, or attack the service's infrastructure
Access or scrape other users' data through automated means or bots
Share your account credentials with unauthorized third parties
Rely on the app for medical decisions in place of a qualified professional

6. Limitation of Liability

To the maximum extent permitted by Dutch and EU law, Sabinitty shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

7. Intellectual Property

All platform code, design, branding, and proprietary AI prompts are the exclusive property of the operator. User-generated content and user data remain the property of the respective user.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time through your account settings. Upon deletion, we will erase all personal data in accordance with our Privacy Policy and GDPR obligations.

9. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in Almere, the Netherlands, unless EU consumer protection regulations provide for an alternative jurisdiction.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days before taking effect. Continued use of the service after the effective date constitutes acceptance.
